Terms of Service

Choose Tonight's Game (choosetonightsgame.com) is operated by Surry Village Creations LLC, a New Hampshire limited liability company ("we", "us", "our").

By using this site you agree to these terms. If you don't agree with these Terms of Service, you may not use the service.

1. What this service is

A publicly readable catalog of board games, built from factual information contributed by users. Signed-in users can submit games, keep a private shelf of games they own, and use tools that suggest what to play.

2. Eligibility and accounts

You must be at least 16 years old to create an account or contribute.

Sign-in is through Google. You are responsible for activity under your account and for keeping your Google account secure. Tell us at surryvillagecreations@gmail.com if you believe someone else is using your account.

We may suspend or close any account at our discretion, including for breaking these terms.

3. Your contributions

"Contribution" means anything you submit: game entries, corrections, and proposed category or mechanic terms.

You keep whatever rights you have in your contributions. You also grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, distribute, and create derivative works from them, for any purpose connected to operating, promoting, or improving the service — including as part of a sale or transfer of the business.

This license survives closing your account. Contributions are merged and edited over time and cannot reliably be separated from the catalog afterwards. When you delete your account, we remove every link between you and your contributions, so what remains is factual information attached to nobody.

To the extent the law allows, you waive any moral rights in your contributions, or agree not to assert them against us.

4. What you promise

For everything you submit, you confirm that:

• you have the right to submit it and to grant the license above
• it is factual information you observed yourself, took from a physical copy of the game or its packaging, or otherwise have the right to share
• it doesn't infringe anyone's copyright, trademark, database right, or other rights
• it doesn't break any agreement you're bound by, including the terms of use of any other board game database or website

5. What you may not submit

• Content copied or scraped from any other database, website, or app — in bulk or otherwise — including descriptions, rules text, editorial content, ratings, or rankings
• Images of any kind, including box art, component photographs, or logos
• Descriptive, narrative, or promotional text about a game
• Anything false, misleading, defamatory, harassing, obscene, or unlawful
• Advertising, spam, or links
• Personal information about anyone
• Automated or scripted submissions without our written permission

We may reject any contribution for any reason.

6. Moderation

Everything is reviewed before publication. We decide what gets published, edited, merged, reclassified, corrected, or removed, and we are not obliged to publish anything, to do so within any timeframe, or to explain a rejection.

Published entries may be edited later by us or, subject to review, by other users. Your contribution may end up merged with others or superseded entirely.

7. The catalog

The catalog as a compiled database is our property. Individual facts within it are not owned by anyone. All rights in the compilation are reserved.

We do not display contributor names. Contributions appear without attribution.

8. Closing your account

You can delete your account at any time from your account settings. See our Privacy Policy for exactly what is deleted.

Deleting your account does not withdraw the license in section 3, and does not require us to remove published contributions from the catalog — though every link between you and them is removed.

9. Copyright complaints

If you believe material here infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to our designated agent:

We respond to valid notices under the DMCA, including by removing material and terminating repeat infringers.

10. No payment

Contributions are voluntary and unpaid. You are not entitled to compensation, and nothing here creates an employment, partnership, or agency relationship.

11. No warranty

THE SERVICE AND THE CATALOG ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

Catalog information is contributed by users and may be wrong, incomplete, or out of date. We do not verify it against any authoritative source. Do not rely on it for purchasing decisions or for judging whether a game is appropriate for a child.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURRY VILLAGE CREATIONS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE U.S. DOLLAR ($1).

Some jurisdictions don't allow these limits, in which case they apply to the fullest extent permitted.

13. Indemnification

You agree to indemnify and hold harmless Surry Village Creations LLC from any claim, loss, or expense (including reasonable legal fees) arising from your contributions or your breach of these terms.

14. Changes

We may change these terms. Material changes will be posted here with a new effective date and emailed to registered users at least 30 days beforehand. Continuing to use the service after that date means you accept them.

15. Governing law

These terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in New Hampshire.
